(b) the contract office is responsible for managing the contract and taking action on behalf of the government in accordance with the terms of the contract; provided that the contract office informs the SBA in advance before publishing a final notice terminating, in whole or in part, the performance of the contract. The contract office also decides before processing a novation contract with the SBA. The contract office may delegate contract management functions to a contract management organisation. As prescribed in point 219.811-3(1), use the following clause: (c) The Contractor agrees that at the same time as it notifies the SBA (as provided for in SBA 8(a) at 13 CFR 124.515), the owner or owners on whom right 8(a) is based will consider relinquishing ownership or control of the business. In accordance with Article 407 of Public Law 100-656, the transfer of ownership or control leads to the termination of the contract for reasons of convenience, unless the SBA waives the requirement of termination before the effective renunciation of ownership and control. (a) This contract is awarded as a direct award between the contract office and the contractor 8(a) in accordance with the partnership contract between the Small Business Administration (SBA) and the Ministry of Defense. Accordingly, even though not mentioned in Section A of this Contract, SBA is the principal contractor and retains responsibility for Certification 8(a), Fitness Requirements 8(a) and related matters, as well as the advice and assistance of Contractor 8(a) under Program 8(a).
